MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A SPECIAL PERMIT <br /> RE: Petition of Anthony Pelusi for a Special Permit SP-90-43 <br /> A Petition was filed by Anthony Pelusi of Reading, Massachusetts <br /> for a Special Permit under Section 174.25.H.6 of the Zoning By-laws <br /> for permission to build and construct a new deck and stairway on <br /> property located in an R-5 zoning district at 4 Melissa Avenue <br /> (Map 21, Block 3) Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on April 9 and April 16, 1990, a copy of which is attached hereto and <br /> made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, April 25, 1990 at 7:30 p.m. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: Cheryl A. Hawver, William J. Hanrahan and Edward M. <br /> Govoni. <br /> Mr. Larry Hall of Benchmark Surveying and Engineering represented <br /> the applicant. The Board was informed that Town Counsel had <br /> reviewed the application and determined that it should be heard <br /> under Section 174-25.H.6. Mr. Hall explained that a new deck <br /> would be built over an existing concrete foundation with no changes <br /> in the setbacks. Comments were received from the Conservation <br /> Commission stating that the wildlife issues of the application would <br /> be addressed in Conservation hearings. There were no comments in <br /> opposition to the Petition. <br /> The Board established that granting this Special Permit would be <br /> in harmony with the general purpose and intent of the By-laws and <br /> complied with the conditions thereof. <br />
