MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A VARIANCE <br /> RE: Petition of Rona R. and Marvin B. Schpeiser for a Variance V-90-42 <br /> A Petition was filed by Ronar R. and Marvin B. Schpeiser of Atlanta, <br /> Georgia on March 21, 1990 for a Variance under Section 174-31 of the <br /> Zoning By-laws for permission to vary the setback requirements in an <br /> R-3 zoning district on property located at 29 Holly Road (Map 112, Block 102) <br /> Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on April 9 and April 16, 1990, a copy of which is attached hereto and <br /> made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, April 25, 1990 at 7:30 p.m. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: Cheryl A. Hawver, William J. Hanrahan and Edward M. Govoni. <br /> Peter Vanderbil, the builder, represented the applicant. He <br /> presented plans for two additions to an existing home and informed <br /> the Board that one of the additions was no longer planned. Comments <br /> were received from an abutter present who had no objections to the <br /> plan. Mr. Vanderbil was advised to submit a revised plan which was <br /> reviewed at the May 23, 1990 meeting of the Board. <br /> The Board found that there were circumstances relating to the shape <br /> of the lot which affected the land in question but did not affect the <br /> zoning district in which the land was located and that a literal <br /> enforcement of the by-laws would create a hardship. The Board <br /> determined that relief could be granted without derogating from <br /> the intent of the by-law and without detriment to the public good. <br />
