MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A SPECIAL PERMIT <br /> RE: Petition of Florence A. Wall for a Special Permit SP-90-45 <br /> A Petition was filed by Florence A. Wall of Mashpee, Massachusetts <br /> on April 12, 1990 for a Special Permit under Section 174-17 of the <br /> Zoning By-laws for permission to change and expand a non-conforming <br /> structure in an R-5 zoning district on property located at 146 Ninigret <br /> Avenue (Map 65, Block 79) Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on May 7 and May 14, 1990, a copy of which is attached hereto and <br /> made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, May 23, 1990 at 7:30 p.m. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: Cheryl A. Hawver, William J. Hanrahan and Edward M. Govoni. <br /> Engineer Charles D. Spohr represented the Applicant. He presented <br /> plans for a living room extension and explained to the Board that a <br /> tool shed on the property had been removed with the result that the <br /> proposed lot coverage would be 20. 129,. <br /> The Board found that the use is in harmony with the general purpose <br /> and intent of the zoning by-laws and complies with the provisions set <br /> forth therein. The Board determined that the extension would not be <br /> substantially more detrimental to the neighborhood than the existing <br /> nonconforming use. <br /> D <br />
