Wall for a Variance V-90-46 <br /> A Petition was filed by Florence A. Wall of Mashpee, Massachusetts <br /> on April 12, 1990 for a Variance under Sections 174-28A and 174-31 of <br /> the Land Space requirements for permission to vary the setbacks and <br /> lot coverage in an R-5 zoning district on property located at <br /> 146 Ninigret Avenue (Map 65, Block 79) Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on May 7 and May 14, 1990, a copy of which is attached hereto and <br /> made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, May 23, 1990 at 7:30 p.m. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: Cheryl A. Hawver, William J. Hanrahan and Edward M. <br /> Govoni. <br /> Engineer Charles D. Spohr represented the Applicant. He presented <br /> plans for a house addition which would result in an increase in lot <br /> coverage to 20.12% and a front setback of 1814" from Sakonnet <br /> Drive. No objections were received from abutters. The Board was <br /> informed that a 9' x 14' storage shed had been removed from the property. <br /> The Board determined that there were circumstances relating to the <br /> fact that the lot was bounded by streets on three sides that affected the <br /> lot in question but did not affect generally the zoning district and that <br /> a literal enforcement of the by-laws would involve hardship to the <br /> petitioner. The Board found that relief could be granted without derogating <br /> from the intent or purpose of the by-laws or detriment to the public good. <br />
