Finn Jr. for a Special Permit SP-90-19
A Petition was filed by John W. Finn Jr. of East Falmouth,
Massachusetts for a Special Permit under Section 174-17 of the Zoning
By-laws for permission to expand a non-conforming structure with a
12' x 12' addition on. property located in an R-5 zoning district at
27 Horseshoe Bend Way (Map 48, Block 9) Mashpee, Massachusetts.
(Owner of record: George T. and Jean O'Donnell) .
Notice was duly given to abutters in accordance with Massachusetts
General Laws Chapter 40A. Notice was given by publication in The
Enterprise, a newspaper of general circulation in the Town of
Mashpee on January 29 and February 5, 1990, a copy of which is
attached hereto and made a part hereof.
A public hearing was held on the Petition at the Mashpee Town Hall
on Wednesday, February 14, 1990 at 7:30 p.m. at which time the
following members of the Board of Appeals were present and acting
throughout: Michael A. Makunas, William J. Hanrahan and Edward M.
Govoni.
Mr. Finn represented the application and presented plans for
a bedroom addition. He explained that the house had been built in
1940 and a deck added at a later date. The Board found that the
plans submitted did not include data on lot coverage required by
the Board and requested the applicant to return at the February 28,
1990 meeting with necessary information. Mr. Finn returned for the
February 28, 1990 but did not submit revised plans. Revised plans
were received April 13, 1990.
Upon motion duly made and seconded the Board of Appeals voted
unanimously on April 25, 1990 to grant the Special Permit subject
