Nickulas for a Special Permit SP-90-01-14 <br /> A Petition was filed by Larry D. Nickulas of W. Hyannisport, <br /> Massachusetts for a modification of Special Permit 87-05-053, Section 3, <br /> for permission to release one lot for the construction of a model home <br /> prior to the payment to the Town of Mashpee for repairs to Pimlico Pond <br /> Road on property located in an R-5 zoning district on Pierre Vernier <br /> Drive, Katian Way and Guners Lane (Map 2, Blocks 141 to 178) Mashpee, <br /> Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on February 12 and February 19, 1990, a copy of which is attached <br /> hereto and made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, February 14, 1990 at 7:30 p.m. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: Michael A. Makunas, Richard E. Halpern and John J. Friel. <br /> Mr. Nickulus represented the Petition. He informed the Board <br /> that his original Special Permit was conditioned with the payment of <br /> $100,000 to the Town for the repair of Pimlico Pond Road. He <br /> requested the release of one lot before making the payment to permit <br /> the construction of a model home. Comments were received from <br /> Ernest Virgilio, Director of Public Works, stating that the Town is <br /> waiting to improve Pimlico Pond Road. The Board determined that <br /> a payment schedule should be established and Mr. Nickulus agreed to <br /> the payment of $25,000 on May 1, June 1, July 3 and August 1, 1990. <br />
