MA 02649 <br /> BOARD OF APPEALS <br /> DECISION FOR A VARIANCE <br /> RE: Petition of Leon Rosenberg for a Variance V-90-01-16 <br /> A Petition was filed by Leon Rosenberg of Newton, Massachusetts <br /> for a Variance under Section 174-31 to vary the maximum lot coverage <br /> on property located in an R-3 zoning district at 127 Popponesset <br /> Island Road (Map 112, Block 18) Mashpee, Massachusetts. <br /> (Owner of record: A. Eugene and Corrine M. Stillman) . <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on January 29 and February 5, 1990 .a copy of which is attached. <br /> A public hearigg was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, February 14, 1990 at '7:30 p.m. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: Michael.A. Makunas, William J. Hanrahan and Richard E. <br /> Halpern. I <br /> Christopher Costa of All Cape Survey Consultants represented the <br /> Applicant. He informed the Board that the Applicant was proposing an <br /> addition to an existing dwelling and the construction of a garage <br /> which would result in total lot coverage of 23%. <br /> Attorney Kevin Kirrane, representing a direct abutter, Alfred <br /> White, presented a brief in opposition to the expansion. The Board <br /> received written comments from another direct abutter, Stephen M. Politi, <br /> in opposition to the Petition. <br /> The Board of Appeals; after carefully considering all of the facts <br /> and evidence submitted at the hearing, made the following findings: <br /> The Board determined that the Petitioner failed to meet the conditions <br /> necessary for the granting of a Variance. There was not sufficient <br /> evidence presented to prove that a literal enforcement of the provisions <br /> of the By-law would involve- substantial hardship. <br />
