II
4Ti i s'
Talull of em Z104pre
P. O. BOX 1106
neje Ld MASHPEE. MA 02649
BOARD OF APPEALS
DECISION
FOR A VARIANCE
RE: Frank P. Peros V-90-24
A Petition was filed by Frank P. Peros of Mashpee, Massachusetts
for a Variance under Section 174-31 of the Zoning By-laws for permission
to vary the lot coverage and set-back requirements on property located
in an R-3 zoning district at 11 Bluff Avenue (Map 111, Block 144)
I Mashpee, Massachusetts.
Notice was duly given to abutters in accordance with Massachusetts
General Laws Chapter 40A. Notice was given by publication in The
Enterprise, a newspaper of general circulation in the Town of Mashpee
on February 12 and February 19, 1990, a copy of which is attached hereto
and made a part hereof.
A public hearing was held on the Petition at the Mashpee Town
Hall on Wednesday, February 28, 1990 at which time the following
members of the Board of Appeals were present and acting throughout:
Cheryl A. Hawver, William J. Hanrahan and Richard E. Halpern.
Mr. Peros informed the Board that he proposed to build a closet
addition 5' x 16' and had earlier applied for a Special Permit but
the Board had determined that a Variance was necessary. There were
no comments from abutters.
The Board determined that the shape of the lot created a hardship
and that relief could be granted without derogating from the intent
or purpose of the Zoning By-laws or without detriment to the public
good.
