Luconi for a Special Permit SP-90-21 <br /> A Petition was filed by Fred and Suzanne M. Luconi of Concord, <br /> Massachusetts for a Special Permit under Section 174-25.I.9 of the <br /> Zoning By-laws for an existing unlicensed pier, ramp and float in <br /> an R-3 zoning district on property located at 30 Sand Dollar Lane <br /> (Map 105, Block 84) Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of <br /> Mashpee on February 12 and February 19, 1990, a copy of which is <br /> attached hereto and made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, February 28, 1990 at which time the following <br /> members of the Board of Appeals were present and acting throughout: <br /> Cheryl A. Hawver, Michael A. Makunas and William J. Hanrahan. <br /> Engineer Jeff Ryther represented the applicant. He presented <br /> plans for an extension to an existing unlicensed pier, ramp and float. <br /> He was unable to document any permits on the original pier which <br /> was estimated to be on the property for 15 years. Objections were <br /> received from the Conservation Commission which stated that the <br /> plan was unacceptable and could not meet the standards of the <br /> Wetlands Protection Act. The Shellfish Constable stated that he <br /> would prefer to see an extension of the original pier to protect <br /> the shellfish beds. <br /> The Board informed the applicant that they could not <br /> legalize an illegal non-conforming structure. <br /> i <br /> I <br />
