MA 02649 <br /> RhVN <br /> BOARD OF APPEALS OfC 05 <br /> y l� <br /> DECISION 6 V <br /> 8 <br /> FOR A VARIANCE <br /> RE: Petition of Marjory Gordon for a Variance V-90-25 <br /> A Petition was filed by Marjory Gordon of Mashpee, Massachusetts <br /> for a Variance from Section 174-31 of the Zoning By-laws for permission <br /> to vary the setback requirements in an R-3 zoning district on property <br /> located at 31 Nick- Trail (Map 117, Block 271) Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on February 26, 1990 and March 5, 1990, a copy of which is attached <br /> hereto and made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, March 14, 1990, at which time the following members <br /> of the Board of Appeals were present and acting throughout: <br /> Cheryl A. Hawver, Michael A. Makunas and Richard E. Halpern. <br /> Builder John Gavin represented the applicant. He informed the <br /> Board that the property now has a metal shed and stone retaining <br /> wall which is in poor condition. Ms. Gordon proposes to replace <br /> it with a wooden deck and storage shed for barrels. An abutter <br /> spoke in favor of the application. <br /> The Board determined that the topography of the lot created a <br /> hardship and that relief could be granted without detriment to the <br /> public good and without derogating from the intent of the By-laws. <br />
