MA 02649
RhVN
BOARD OF APPEALS OfC 05
y l
DECISION 6 V
8
FOR A VARIANCE
RE: Petition of Marjory Gordon for a Variance V-90-25
A Petition was filed by Marjory Gordon of Mashpee, Massachusetts
for a Variance from Section 174-31 of the Zoning By-laws for permission
to vary the setback requirements in an R-3 zoning district on property
located at 31 Nick- Trail (Map 117, Block 271) Mashpee, Massachusetts.
Notice was duly given to abutters in accordance with Massachusetts
General Laws Chapter 40A. Notice was given by publication in The
Enterprise, a newspaper of general circulation in the Town of Mashpee
on February 26, 1990 and March 5, 1990, a copy of which is attached
hereto and made a part hereof.
A public hearing was held on the Petition at the Mashpee Town
Hall on Wednesday, March 14, 1990, at which time the following members
of the Board of Appeals were present and acting throughout:
Cheryl A. Hawver, Michael A. Makunas and Richard E. Halpern.
Builder John Gavin represented the applicant. He informed the
Board that the property now has a metal shed and stone retaining
wall which is in poor condition. Ms. Gordon proposes to replace
it with a wooden deck and storage shed for barrels. An abutter
spoke in favor of the application.
The Board determined that the topography of the lot created a
hardship and that relief could be granted without detriment to the
public good and without derogating from the intent of the By-laws.
