MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A SPECIAL PERMIT <br /> RE: Application of Kempton Kab Inc. for a Special Permit SP-90-34 <br /> A Petition was filed by Kempton Kab Inc. (Owner of record: <br /> Riverbend Realty Trust) - for a Special Permit under Section 174-17 <br /> of the Zoning By-laws for permission to change a non-conforming <br /> use in an R-5 zoning district on property located at 100 Great Neck <br /> Road North (Map 45, Block 3) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on February 26 and March 5, 1990, a copy of which is attached hereto <br /> and made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, March 14, 1990 at 7:30 p.m. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: Cheryl A. Hawver, Michael A. Makunas and John J. Friel. <br /> Theresa Kempton represented her Petition. She informed the Board <br /> that she required an office for her taxi company before Selectmen would <br /> issue a license. She planned to have three cabs and expected that <br /> one of them would be at the office location and the others at stands <br /> in Mashpee Commons and Deer Crossing. The proposed office has been <br /> used as a real estate office. <br /> A direct abutter and a concerned citizen of Mashpee both objected <br /> to the Petition and stated that night parking, particularly in the <br /> summer, was already a problem in the area. <br /> The Board did not find that the granting of this Special Permit <br /> would be in harmony with the general purpose and intent of the By-laws. <br />
