MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A SPECIAL PERMIT <br /> RE: Application of James Reiffarth for a Special Permit SP-90-27 <br /> A Petition was filed by James B. and Margaret Reiffarth of <br /> West Medway, Massachusetts for a Special Permit under Section 174-17 <br /> of the Zoning By-laws for permission to extend a non-conforming <br /> structure with a building addition and deck in an R-3 zoning district <br /> on property located at 422 Monomoscoy Road (Map 124, Block 48) <br /> Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on February 26 and March 5, 1990, a copy of which is attached hereto <br /> and made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town Hall <br /> i <br /> on Wednesday, March 14, 1990 at 7:30 p.m. at which time the following <br /> members of the Board of Appeals were present and acting throughout: <br /> Cheryl A. Hawver, Michael A. Makunas and John J. Friel. <br /> Attorney Kevin Kirrane represented the applicant,and presented <br /> plans for a house addition of 216 square feet and an 8 foot by 10 foot <br /> deck. He explained that the Board of Health had denied the septic <br /> plans and a new septic system was being designed. Elias McQuaid, <br /> Health Agent, requested the Board to condition any Special Permit <br /> with the requirement that the septic plans receive the approval of <br /> the Board of Health. <br /> The Board determined that the use is in harmony with the general <br /> purpose and intent of the Zoning By-laws and complies with the <br /> provisions set forth within the By-laws. The Board found that the <br /> change or extension would not be a detriment to the neighborhood. <br />
