MA 02649BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> RE: Petition of Linda Young SP-90-73 <br /> A Petition was filed by Linda Young of Mashpee, Massachusetts <br /> on August 10, 1990 for a Special Permit under Section 174-17 of the <br /> Zoning By-laws for permission to expand a non-conforming structure <br /> with the construction of house additions and decks in an R-3 zoning <br /> district on property located at 167 Water .Way (Map 111, Block 87) <br /> Mashpee, Massachusetts. (Owner of record: Meyer J. Shnitzler) . <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on September 10 and September 17, 1990, a copy of which is attached <br /> hereto and made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, September 26, 1990 at 7:30 P.M. .at which time <br /> the following members of the Board of Appeals were present and <br /> acting throughout: Michael A. Makunas, William J. Hanrahan and <br /> Edward M. Govoni. <br /> Builder Peter Vanderbil represented the Applicant. He presented <br /> plans for additions to the house and proposed decks which would <br /> result in lot coverage of 12.69. <br /> The Board found that the use was in harmony with the general <br /> purpose and intent of the by-laws and complied with the provisions thereof. <br /> The Board determined that the extension would not be more detrimental <br /> to the neighborhood than the exisiting nonconforming use. <br />
