MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> RE: Leon Rosenberg for a Special Permit SP-90-75 <br /> A Petition was filed by Leon Rosenberg of Newton, Massachusetts <br /> on August 13, 1990 for a Special Permit under Section 174-17 of the <br /> Zoning By-laws for permission to expand a non-conforming structure <br /> with the construction of house additions and deck in an R-3 zoning <br /> distric on property located at 127 Popponesset Island Road (Map 112, <br /> Block 18) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee, <br /> on September 10 and 17, 1990, a copy of which is attached hereto and <br /> made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, September 26, 1990 at 7:30 P.M. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: Michael A. Makunas, William J. Hanrahan and John J. Friel. <br /> Engineer Chris Costa represented the applicant. He reviewed an <br /> earlier application to the Board which had been denied because of <br /> excessive lot coverage and informed the Board that the applicant had <br /> revised. plans to result in a 15.8% lot coverage. <br /> The Board of Appeals found that the use is in harmony with the <br /> general purpose and intent of the by-laws and complies with the <br /> provisions thereof. The Board determined that the extension was not <br /> more detrimental to the neighborhood than the existing non-conforming <br /> use. <br />
