MA 02649 <br /> BOARD OF APPEALS <br /> DECISION FOR A VARIANCE <br /> RE: David and Fira Schneider - V-90-81 <br /> r <br /> A Petition was filed by David and Fira Schneider of Needham, <br /> Massachusetts on September 12, 1990 for a Variance from Section <br /> 174-31 of the Zoning By-laws for permission to vary the front, =near and <br /> side setback requirements in an R-5 zoning district on property <br /> located at 3 Hillside Avenue (Map 49, Block 188) Mashpee, Massachusetts. <br /> t <br /> (Owner of record: Gerald J. Betro) . <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on September 24 and October 1, 1990, a copy of which is attached hereto <br /> and made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town Hall <br /> on Wednesday, October 10, 1990 at 7:30 P.M. at which time the following <br /> members of the Board of Appeals were present and acting throughout: <br /> Cheryl A. Hawver, Michael A. Makunas and William J. Hanrahan. <br /> Diane Thompson represented the applicant. She informed the <br /> . Board that Mr. and Mrs. Schneider had a purchase and sale agreement <br /> on the property and planned to construct a single family home <br /> with 187 lot coverage. The lot is located at the corner of Hooppole <br /> Road and Hillside Avenue and the Board was informed that the lot would <br /> be unbuildable if required to maintain the setbacks from both streets. <br /> The Board determined that there were circumstances relating to the <br /> topography which affected the land in question but did.not affect <br /> generally the zoning district and that a literal enforcement of the <br /> by-laws would involve substantial hardship. The Board found that <br /> desirable relief could be granted with derogating from the intent and <br /> purpose of the by-laws or without detriment to the public good. <br />
