BOX 1108 <br /> AHTS MASHPEE, MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A SPECIAL PERMIT <br /> RE: Mark Eynatian for a Special Permit SP-90-84 <br /> A Petition was filed by Mark Eynation of Chelmsford, Massachusetts <br /> for a Special Permit under Section 174-17 of the Zoning By-laws for <br /> permission to expand a non-conforming use with the construction of a <br /> single family residence in an R-3 zoning district on property located <br /> at 51 Uncle Edwards Road (Map 117, Block 221) Mashpee, Massachusetts. <br /> (Owner of record: B. Kenneth & Ruth H. Eynation) . <br /> Notice was duly given to abutters in accordance with Massachusetts . <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee, <br /> on October 29 and November 5, 1990, a copy of which is' attached hereto <br /> and made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, November 14, 1990 at 7:30 p.m. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: Cheryl A. Hawver, Michael A. Makunas and William J. <br /> Hanrahan. <br /> Engineer David Sanicki presented plans for a proposed home which <br /> would require 22.3% lot coverage. Objections were received from <br /> abutters on the size of the house and plans were revised to reduce <br /> the lot coverage to 19.8% and letters were received from abutters in <br /> favor of the revisions. <br /> The Board found that the proposed use is in harmony with the <br /> general purpose and intent of the By-laws and complies with the <br /> provisions thereof. The Board determined that the expansion of <br /> non-conforming use would not be a detriment to the neighborhood. <br />
