MA 02669 <br /> BOARD OF APPEALS <br /> DECISION FOR A VARIANCE <br /> RE: William Sullivan V-90-61 <br /> A Petition was filed by William Sullivan of Walpole, Massachusetts <br /> for a Variance under Sections 174-31 and 174-33 of the Zoning By-laws <br /> for permission to vary the setbacks in an R-3 zoning district on <br /> property located at 6 Daniel's Island Road (Map 100, Block 18) <br /> Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on August 6 and August 13, 1990, a copy of which is attached hereto <br /> and made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town Hall <br /> on Wednesday, August 22, 1990 at 7:30 p.m. at which time the following <br /> members of the Board of Appeals were present and acting throughout: <br /> Cheryl A. Hawver, Michael A. Makunas and William J. Hanrahan. <br /> Engineer John Slavinsky represented the applicant. The Board <br /> was informed that the Conservation Commission had required a change <br /> in plans which had earlier been granted a Special Permit and Variance. <br /> Revised plans were presented which had been approved by Conservation <br /> and required a setback of 34' from the wetlands to a proposed deck <br /> and a 22' setback to a proposed pool and a 10' front setback to a <br /> garage. <br /> The Board found that there were circumstances relating to the <br /> topography of the lot which affected the land in question but did not <br /> affect generally the zoning district in which the land is located and <br /> due to those circumstances a literal enforcement of the by-laws would <br /> create a hardship. The Board determined that granting this variance <br /> request would.not derogate from the intent of the By-laws and would <br /> not be a detriment to the surrounding neighborhood. <br />
