Benison for a Special Permit SP-90-5 <br /> A Petition was filed by Anthony J. Benison of Worcester, Massachusetts <br /> on July 11, 1990 for a Special Permit under Section 174-17 of the Zoning <br /> By-laws for permission to expand a non-conforming structure with the <br /> construction of decks and walkway in an R-3 zoning district on <br /> property located at 16 Elliot Road (Map 117, Block 136) Mashpee, <br /> Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on August 20 and August 27, 1990, a copy of which is attached hereto <br /> and made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, September 5, 1990 at 7:30 p.m. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: Cheryl A. Hawver, Michael A. Makunas and William J. <br /> Hanrahan. <br /> Attorney Kevin Kirrane represented the applicant. He informed <br /> the Board that the construction of additions to the home had been <br /> performed without permits and the owner had been cited for the <br /> violations by the Building Department. Comments were received from <br /> abutters both in favor of and opposed to the Application. <br /> The Board of Appeals found that the use is in harmony with the <br /> general purpose and intent of the by-laws and complies with the <br /> provisions thereof. The Board determined that the extension was not <br /> more detrimental to the neighborhood than the previous non-conforming <br /> use. <br />
