BOX 1108 <br /> ABLE MASHPEE, MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> RE: Application of David Holden for a Special Permit SP-90-59 <br /> A Petition was filed by David Holden of Norwell, Massachusetts <br /> on July 12, 1990 for a Special Permit under Section 174-17 of the <br /> Zoning By-laws for permission to expand a non-conforming structure <br /> in an R-3 zoning district on property located at 62 Bayview Road <br /> (Map 119, Block 52) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on August 20 and August 27, 1990, a copy of which is attached hereto <br /> and made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town Hall <br /> on Wednesday, September 5, 1990 at 7:30 p.m. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: Cheryl A. Hawver, Michael A. Makunas and William J. <br /> Hanrahan. <br /> Engineer David Sanicki represented the applicant. He presented <br /> plans for a house, garage and deck to replace an existing house on <br /> the property. Comments were received from the Board of Health approving <br /> plans dated December 7, 1989 and revised July 24, 1990. Conservation <br /> Commission had issued an Order of Conditions for the construction. <br /> The Board of Appeals found that the use is in harmony with the <br /> general purpose and intent of the by-laws and complies with the <br /> provisions thereof. The Board determined that the extension would <br /> not be substantially more detrimental to the neighborhood than the <br /> existing non-conforming use. <br />
