Box 1108 <br /> Mashpee, MA 02649 <br /> Dear Ms. Labute: <br /> RE: Forward Development Corporation <br /> Ouashnet Woods Subdivision Mashpee MA <br /> Please be advised that this office represents Forward <br /> Development Corporation of Pittsfield, Massachusetts who is <br /> the owner of the property located on Route 28 in Mashpee <br /> known as the Quashnet Woods Subdivision. <br /> On July 23 , 1990, Forward Development Corporation <br /> approached the Town of Mashpee Selectmen and requested <br /> approval of their Open Space Incentive Development project, <br /> pursuant to Section 22D of the Cape Cod Commission Act. The <br /> Selectmen, on a vote of two to two (one absent) did not grant <br /> the approval . <br /> By this letter, we formally request to appeal such <br /> decision to the Town of Mashpee Zoning Board of Appeals. <br /> This appeal is being made pursuant to Chapter 40A, Section <br /> 15 and is based on the allegation that the decision made by <br /> the Selectmen was: <br /> a) arbitrary and capricious in light of the information <br /> in their possession; and <br /> b) not made based on legally sufficient reasoning. <br />
