BOX 1108 <br /> MASHPEE, MA 02649 <br /> BOARD OF APPEALS <br /> DECISION ON REQUEST FOR AN EXTENSION OF SPECIAL PERMIT <br /> RE: Fields Point Limited Partnership SP-90-67 <br /> A Petition was filed by Fields Point Limited Partnership <br /> requesting an extension of Special Permit 88-09-071 issued to <br /> Dana Pierce, Trustee of Landmark Realty Trust and filed with the <br /> Town Clerk on December 5, 1988 for property located in a C-1 <br /> zoning district between Falmouth Road and Donna's Lane <br /> (Map 74, Blocks 7 and 12) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A, Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on August 27 and September 3, 1990, a copy of which is attached hereto <br /> and made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town Hall <br /> on Wednesday, September 12, 1990 at 7:30 p.m. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: Michael A. Makunas, John J. Friel and Edward M. Govoni. <br /> Douglas S. Storrs of Fields Point Ltd. Partnership represented <br /> the Petition. He informed the Board that Fields Point had recently <br /> completed negotiations to purchase these lots and were requesting <br /> the extension to allow more time for planning the use of the land. . <br /> Mr. Storrs was informed that a modification of the original permit <br /> would be required if there were any substantial changes from the <br /> original conditions of Special Permit 88-09-071. <br /> The Board found that there was just cause in granting the <br /> extension since access from Donna's Lane is unresolved and traffic <br /> studies of Route. 28 were being reviewed. <br />
