Good evening. My name is Duncan Campbell. My wife, MaryAnn and I live at 4 <br />Mohican Avenue behind the fence that is behind the restaurant and patio at Dino's Sports <br />Bar. <br />I've known Dino for the best part of 40 years, beginning when I lived in Hyannis. We <br />bought the house on Mohican Ave behind the restaurant in 2004 when there was no patio <br />at Dino's. A few years ago, the patio was constructed, and with it came the excessively <br />loud music. <br />A few years ago, we and our neighbors met with Dino in person and he assured us that he <br />would change the speaker location, direction, and volume to diminish the noise level, <br />which has been our main objective since the patio opened. We're not trying to <br />eliminate the music, just lower the volume to an acceptable level. Last night, for <br />example, the singer was literally screaming into the microphone. <br />We've called the police numerous times as has our neighbors, and the first time a police <br />officer came I took him out to our deck and he agreed that it was very loud. He said he <br />would talk to Dino the next day when things calm down since it was a very busy <br />Saturday night. The next day the officer from the previous night visited and said he did <br />talk to Dino who agreed to turn down the music. He did not. <br />After a while we all stopped calling the police because we collectively felt it was futile. <br />Our next step was to approach the Town Manager, Rodney Collins, and we met with him <br />in May. Mr. Collins said we should approach the Board of Selectmen to try to obtain a <br />noise ordinance in Mashpee, but first he would talk to Dino privately which he did on <br />June 6, 2016. And once again, as Dino assured him he would address this, he did <br />nothing and the music level is unchanged. <br />On a personal note, my wife is an ICU nurse at Cape Cod Hospital and on weekends <br />works 12 -hour shifts. She needs to be in bed by 7:30 pm to getup at 4:30 am for an <br />early shift We close the windows and the blinds, and turn on a fan and AC to dampen <br />the noise. Additionally, she wears earplugs but the music is still so intrusive that she has <br />a very difficult time falling asleep before 9:30 or 10 pm on Fri and Sat depending on how <br />late they play. When Mr.Collins mentioned this to Dino his response was "Her word <br />against ours." <br />In my opinion, I believe Dino thinks that, by turning down the volume he will lose <br />business and money. I attended the Gringos concert last Sunday, and my friends and I <br />were having a difficult time understanding one another due to the loud volume on the <br />patio. Additionally, we feel this could be detrimental to the value of our home if and <br />when we decide to sell. <br />All we have been asking for is to establish a middle ground, where his customers, the <br />band, and the neighbors can feel comfortable. Perhaps, having a decibel meter on the <br />patio, he can inform the bands to play within an acceptable level. <br />Thank you for your time and consideration. <br />
