X <br />QUESTION NO. 1 <br />PROPOSED AMENDMENT TO THE CONSTITUTION <br />Do you approve of the adoption of an amendment to the constitution <br />summarized below which was approved by the General Court in a joint <br />session of the two branches held March 29, 1961, received <br />219 votes in the affirmative and 26 in the negative, and in [YES]/ 93 <br />a joint session of the two branches held May 8, 1963, re- <br />ceived 244 votes in the affirmative and 14 in the negative? ND f% <br />SUMMARY <br />The proposed amendment provides that the terms of office of the <br />Governor, Lieutenant Governor, Secretary of the Commonwealth, <br />Treasurer and Receiver General, Attorney General and Auditor shall <br />be four years. Executive Councillors, Senators and Representatives <br />shall continue to serve for two years. The four-year term for consti- <br />tutional officers would become effective at the time of the November <br />election in the year 1966. <br />QUESTION NO. 2 <br />PROPOSED AMENDMENT TO THE CONSTITUTION <br />Do you approve of the adoption of an amendment to the constitution <br />summarized below which was approved by the General Court in a joint <br />session of the two branches held July 18, 1962, received <br />238 votes in the affirmative and 1 in the negative, and in <br />a joint session of the two branches held May 8, 1963, re- <br />ceived 246 votes in the affirmative and 2 in the negative? ND / <br />SUMMARY <br />In the event that any public office, whether elective or appointive, <br />shall become vacant as a result of enemy attack, the proposed amend- <br />ment would enable the General Court to provide for prompt and tem- <br />porary succession to the powers and duties of such offices, and to take <br />steps to insure continuity of government of the Commonwealth and its <br />political subdivisions. <br />QUESTION NO. 3 <br />PROPOSED AMENDMENT TO THE CONSTITUTION <br />Do you approve of the adoption of an amendment to the constitution - <br />summarized below which was approved by the General Court in a joint <br />session of the two branches held March 29, 1961, received <br />251 votes in the affirmative and 0 in the negative, and in YES x6 <br />a joint session of the two branches held May 81 1963, re- <br />ceived 252 votes in the affirmative and 3 in the negative? ND 3 , <br />SUMMARY j <br />The proposed amendment provides that the credit of the Common- <br />wealth may be given, loaned or pledged only by a two-thirds vote of <br />each branch of the Legislature. In no event shall the credit of the <br />Commonwealth be given or loaned to or for any individual, private <br />association or corporation privately owned or managed. <br />QUESTION NO. 4 <br />PROPOSED AMENDMENT TO THE CONSTITUTION <br />Do you approve of the adoption of an amendment to the constitution <br />summarized below which was approved by the General Court in a joint <br />session of the two branches held July 18, 1962, received <br />220 votes in the affirmative and 24 in the negative, and in YE$ /6 <br />a joint session of the two branches held May 8, 1963, re- ND <br />ceived 258 votes in the affirmative and 1 in the negative? <br />SUMMARY <br />The proposed amendment authorizes both the Governor and the <br />Executive Council to require opinions of the Justices of the Supreme <br />judicial Court on questions of law. The present requirement that the <br />Governor and Council agree before a question may be submitted <br />would be annulled. <br />QUESTION NO. S <br />LAW PROPOSED BY INITIATIVE PETITION <br />Do you approve of a law summarized below which was disapproved <br />in the House of Representatives by a vote of 109 in the <br />affirmative and 109 in the negative and was disapproved YES I f 1-- i <br />in the Semite by a vote of 16 in the affirmative and 20 in <br />the negative? ND 76 <br />SUMMARY <br />The proposed measure provides that henceforth appointments in the <br />executive branch of the government shall not require the advice and <br />consent of the Governor's Council. Exceptions to this provision in- <br />clude appointments to the Youth Service Board, Industrial Accident <br />Board, Commission of the Department of Public Utilities, Parole Board <br />and Appellate Tax Board, which appointments shall continue to require <br />Council action. However, should the Council fail to act upon such ap- <br />pointments within thirty calendar days, then the person involved shall <br />be deemed to have been lawfully appointed. Any appointment in the <br />executive branch by an officer other than the Governor which hereto- <br />fore required Council approval shall henceforth require approval by the <br />Governor. 1 <br />Removals from office shall no longer require the advice and consent <br />of the Council, except in the use of the Youth Service Board. which re- <br />(CearrIMUED) <br />movals must still receive Council approval. As in the ease of appoint- <br />ments still requiring Council approval, such recommended removal <br />from the Youth Service Board must be acted upon by the Council <br />within thirty calendar days; otherwise the proposed removal shall <br />become effective as if approval had been gives. To the case of any ap- <br />pointment which heretofore required Council approval the Governor <br />may, within fifteen days of the making of the appointment, remove the <br />person appointed without cause. <br />The Council shall no longer be required to approve the tixiag of any <br />compensation for services rendered in the executive department. <br />And henceforth there need be no approval by the Council of actions or <br />agreements by executive officers, Including but not limited to borrow- <br />ings and loans, investments, leases, licenses, purchases and convey- <br />ances, and contracts, and also including the promulgation of rales and <br />regulations. <br />Notwithstanding the foregoing, the Governor shall at all times re- <br />main free to seek the advice and consent of the Council upon any <br />matter. <br />QUESTION NO. 6 <br />LAW SUBMITTED UPON REFERENDUM AFTZR PASSAGE <br />Do you approve of a law summarized below, which was approved in <br />the House of Representatives by a vote of 1110 in the <br />affirmative and 40 in the negative and was approved in YES /e 0 <br />the Senate by a vote of 28 in the affirmative aril S in &a <br />negative? NO /0 Z <br />SUMMARY <br />Under the Act, effective as of January 1, 1964, each member of the <br />General Court shall receive seventy-eight hundred dollars for each <br />regular annual session, the President of the Senate and Speaker of the <br />House of Representatives shall each receive the same amount as addi- <br />tional compensation, and the floor leaden of each of the major political <br />parties in the Senate and House, the Chairman of the Senate Com- <br />mittee on Ways and Means and the Chairman and Vice -Chairman of <br />that committee of the House, shall each receive thirty-niase hundred <br />dollen as additional compensation, to be paid as provided in the Act. <br />After the same date the annual expanse allowance is to be six hundred <br />dollars for each member and the travel allowance is to be eight cents <br />per mile with a stated minimum and an alternative, and a member <br />chosen to fill a vacancy or who resigns during a women is to be en- <br />titled to per diem compensation at the rate for each regular annual ses- <br />sion and to the allowances for travel and other expenses for the time of <br />his membership. <br />It is also provided that in addition to the compensation for the 1963 <br />annual session the President of the Senate and Speaker of the House <br />shall be paid thirty-nine hundred dollars, the floor leaden of each <br />major political party in the Senate and House, the Chairman of the <br />Senate Committee on Ways and Meals and Chairman and Vice - <br />Chairman of that committee of the Hoene, shall be paid twenty-nine <br />hundred and twenty-five dollars and each other amber shall be paid <br />nineteen hundred and fifty dollars. Foch member shall also be en- <br />titled to an additional expense allowance of two hundred dollars for <br />the calendar year 1963 and the travel allowance aball be at the rate of <br />eight cents per mile with a stated minimum and an alternative for the <br />balance of the calendar year 1963. <br />QUESTION NO. 7 <br />A.
