203 <br />Special Town Meeting <br />Article 12_Ctd: <br />-3- <br />August 4, 1971 <br />Section 5. The Council shall prepare and submit an annual report of <br />its activities to the Town and shall send a copy thereof to the <br />Commission of Aging. <br />Section -6. The Council may appoint such clerics and other employees as <br />it' may require. <br />ACTION: Motion duly made and seconded Section 6 by amended to read: <br />The Council may appoint such clerks and other employees as it <br />may require without compensation. <br />Motion duly made and seconded article be accepted as amended. <br />60 for, 20 opposed. A vote. <br />ARTICLE 13. To see what sum of money the Town will vote to raise and <br />appropriate for the use of the Council on Aging. <br />ACTION: Motion duly made and seconded the Town raise and appropriate <br />the sum of $350.00 for the use of the Council on Aging. A <br />unanimous vote. <br />ARTICLE 14. To see if the Town will vote to raise and appropriate or <br />take from available funds the sum of $2,400.00 to supplement the Life- <br />guards and Attendents' Salaries Account. This amount to be used to <br />pay time and one-half for overtime per State Law, which was not figured <br />in the 1971 budget. <br />ACTION: Motion duly made and seconded the Town raise and appropriate the <br />sum of $2,400.00. A unanimous vote. <br />ARTICLE 15. To see if the Town will vote to amend the Town Zoning By - <br />Laws by repealing the existing Zoning By -Laws being Article II of Chapter <br />III of the Town By -Laws and enacting in their place new Zoning By -Laws <br />consisting of fourteen sections together with a map of zoning districts <br />all being included in a 33 page booklet entitled "Mashpee, Mass. Pro - <br />,posed Zoning By -Laws 1971", copies of which are on file with the Town <br />Clerk and the Secretary of the Planning Board, extra copies being <br />available to voters at the Town Clerk's Office, or take any other action <br />thereon. <br />The following amendments were adopted: <br />Page 4 <br />2.17 Marina <br />An area for storage or mooring of boats with frontage on <br />a navigable body of water and with facilities for the landing <br />of boats if the storage is on land. If storage is to be on <br />land of a transient nature, requiring frequent launchings <br />and landings, it.shall be inside a building. <br />2.27 Street <br />A public way or private way on record at the Registry of Deeds <br />which affords a principal means of adequete access to abutting <br />property and open to travel by the general public or a way <br />shown on a subdivision plan duly approved by the planning <br />board under the subdivision control statue. <br />Page 10 <br />Section 5•-- Non -Conforming Buildings and Uses <br />Any lawful use of any structure or land or both may be con- <br />tinued although not conforming with the provisions of this <br />By -Law, but no such lawfully non -conforming use shall be <br />changed, intensified, extended or enlarged in any manner <br />except as permitted by the Board of Appeals and such permission <br />shall be based on the same conditions, as set forth in Section <br />6.2 of this by-law and futher pfovide the board finds there <br />is adequete land area to provide sufficient parking and set- <br />backs as may be required. <br />
