11 <br /> Board of Selectmen <br /> Minutes <br /> January 23, 2017 <br /> NEW BUSINESS <br /> Certification of hiring process, Firefighter, Torey Montesi: <br /> Mashpee Fire Chief Thomas Rullo was before the Board to request certification of the hiring <br /> process for Firefighter Torey Montesi. It was noted Mr. Montesi will be rehired as a Step 2 <br /> Firefighter/EMT. The intended date of hire is January 27, 2017. <br /> Motion made by Selectman Sherman to certify and confirm the hiring of Firefighter/EMT <br /> Torey Montesi as recommended. <br /> Motion seconded by Selectman O'Hara. <br /> VOTE: Unanimous. 5-0. <br /> Roll Call Vote: <br /> Selectman Gottlieb, yes Selectman Cahalane, yes Selectman O'Hara, yes <br /> Selectman Cotton, yes Selectman Sherman, yes Opposed, none <br /> Discussion of formation of Joint Powers Authority by the Cape Light Compact: <br /> Correspondence was received from Maggie Downey; Compact Administrator of the Cape Light <br /> Compact dated January 13, 2017 relative to the Joint Powers Authority, an act which allows <br /> governmental units to enter into Joint Powers Agreements. Under the Joint Powers statute there <br /> is no liability of one governmental unit for the acts or omissions of another participating <br /> governmental unit or in the Joint Powers Entity itself. <br /> In 2016, Barnstable County notified the Cape Light Compact (CLC) that it no longer wishes to <br /> continue to render administrative and fiscal services. The formation of a Joint Powers Entity <br /> (JPE) would provide the CLC with the administrative and fiscal functions that Barnstable County <br /> does not wish to provide. With the termination of the Barnstable County relationship, the <br /> Compact would need a new fiscal agent by June 30, 2017 or with an extension, December 31, <br /> 2017 or explore other options such as a Joint Powers Entity (JPE) to serve as the Compact's <br /> administrative agent, and to eventually serve as the operational successor to the Compact. <br /> It was noted that Barnstable County wishes to opt out of the CLC as it represents liability, as <br /> well as retirement responsibilities. A member town acting as the fiscal agent is required to allow <br /> the Compact to use its Federal Identification Number for tax purposes. It was recommended the <br /> Board further review the direction of other Cape towns with respect to this regard, and request <br /> through the Town Manager that Town Counsel be briefed on this matter. <br />
