11 Board of Selectmen Minutes January 23, 2017 NEW BUSINESS Certification of hiring process, Firefighter, Torey Montesi: Mashpee Fire Chief Thomas Rullo was before the Board to request certification of the hiring process for Firefighter Torey Montesi. It was noted Mr. Montesi will be rehired as a Step 2 Firefighter/EMT. The intended date of hire is January 27, 2017. Motion made by Selectman Sherman to certify and confirm the hiring of Firefighter/EMT Torey Montesi as recommended. Motion seconded by Selectman O'Hara. VOTE: Unanimous. 5-0. Roll Call Vote: Selectman Gottlieb, yes Selectman Cahalane, yes Selectman O'Hara, yes Selectman Cotton, yes Selectman Sherman, yes Opposed, none Discussion of formation of Joint Powers Authority by the Cape Light Compact: Correspondence was received from Maggie Downey; Compact Administrator of the Cape Light Compact dated January 13, 2017 relative to the Joint Powers Authority, an act which allows governmental units to enter into Joint Powers Agreements. Under the Joint Powers statute there is no liability of one governmental unit for the acts or omissions of another participating governmental unit or in the Joint Powers Entity itself. In 2016, Barnstable County notified the Cape Light Compact (CLC) that it no longer wishes to continue to render administrative and fiscal services. The formation of a Joint Powers Entity (JPE) would provide the CLC with the administrative and fiscal functions that Barnstable County does not wish to provide. With the termination of the Barnstable County relationship, the Compact would need a new fiscal agent by June 30, 2017 or with an extension, December 31, 2017 or explore other options such as a Joint Powers Entity (JPE) to serve as the Compact's administrative agent, and to eventually serve as the operational successor to the Compact. It was noted that Barnstable County wishes to opt out of the CLC as it represents liability, as well as retirement responsibilities. A member town acting as the fiscal agent is required to allow the Compact to use its Federal Identification Number for tax purposes. It was recommended the Board further review the direction of other Cape towns with respect to this regard, and request through the Town Manager that Town Counsel be briefed on this matter.
