Draft#6 September 7,2017 <br /> Article 12 (D#6) <br /> To see if the Town will vote to authorize the Conservation Commission to enter into a 30 year <br /> lease,in consideration of nominal payment to the Town and other pubiic/environmental benefits <br /> to be provided by a prospective lessee, with respect to that certain parcel of Town owned land <br /> identified on Mashpee Assessor's Map 85 as Parcel 1-0 and located at 91 Milford Road (Also <br /> known as Childs River Conservation Area) in Mashpee, Barnstable County, Massachusetts, <br /> consisting, of 24.70 acres, more or less, for the purpose of facilitating implementation of the <br /> Childs River Restoration Project and improving the conservation, recreational and open space <br /> qualities of the subject land consistent with the permitted uses of said land under Article 97 of <br /> the Amendments to the Massachusetts Declaration of Rights, and to authorize the Conservation <br /> Commission to enter into all agreements and to execute any and all instruments on behalf of the <br /> Town as m.ay be necessary to effect such a lease, or take any other action relating thereto. <br /> Submitted by.the Board of Selectmen <br /> Explarsatiort This,article seeks to authorize the Conservation Commission to negotiate <br /> and enter <br /> into. a long term-.(30 year).-:lease agreement whereby-the property=located at 91 Milford Road, <br /> which is held by the Towri for conseriiation/open space,purposes;-.would be leased to:a private <br /> entity or.entltieO' r the:J)urpose of..facilitating-.implementation of.the Childs River Restoration <br /> Project and improving the,cCinservation, recreational and open space qualities of the.subject <br /> land:`The objective:of the Town is to maintain 6Wnership�of the subject land white entering into <br /> a joint venture w th"othei property owners) in thevictnity of the Childs River whereby public and <br /> private resourced can be utilized to'co.ordinate tl�e Cliilds'River restoration efforts and maximize <br /> public benefits; _consistent: with the'..permitted uses of_said land under Article 97 of the <br /> Amendments to the Massachusetts Declaration of Rights <br /> The Board of Selectmen recommends Town Meeting approval by a vote of x-x <br /> The Finance Committee recommends Town Meeting approval by a vote of 5-0 <br /> Article 13 (D#6) (Zoning Bylaw adopting a temporary moratorium) <br /> To see if the Town will vote to adopt the following Zoning Bylaw relative to implementing a <br /> temporary moratorium until December 31, 2018 on the use of-land or structures for recreational <br /> marijuana establishments and marijuana retailers in the Town in order for the Town to have <br /> sufficient time and opportunity to review yet to be promulgated Cannabis Control Commission <br /> regulations relative to said uses and to consider and develop appropriate local Zoning Bylaws <br /> pursuant to comprehensive planning studies and appropriate public planning processes, or take <br /> any other action relating thereto: <br /> Add the following new Section: "174-48.6 Marijuana Establishments" <br /> A.
