CAPE COD MUNICIPAL MANAGEMENT ASSOCIATION
Barnstable
Mark Ells
Andrew Clyburn
Bourne
Tom Guerino .
Brewster August 24,2017
Michael Embry
Donna Kalinick
Chatham The Honorable Robert A.DeLeo
Jill Goldsmith , Speaker of the House
State House,Boston
Dennis
Elizabeth Sullivan Re: An Act Rezulatiwand1risuriniz'Short-lerm Rentals
Taylor Cobb
Eastham Dear Speaker DeLeo:
Jacqui Beebe.
Mike Lorenco I write to you on behalf of the Cape Cod Town Managers and
Falmouth
Julian Suso Administrators Association to express our support for the passage of
Peter Johnson-Staub legislation regulating and taxing short term rentals. This is also to provide
an overview of some practical concerns that we respectfully request you will
Harwich consider as H.3454,An Act Regulating and Insuring Short-Term Rentals,
Chris Clark and any other legislation related to regulating and taxing short-term rentals,
Charleen Greenhalgb proceeds through the legislative process.
Mashpee According to a recent analysis of the Cape Cod regional housing
Rodney Collins market,Barnstable County is home to 49%of the seasonal housing units
Wayne Taylor
Nantucket state-wide. Importantly, the market analysis also concludes that seasonal
Libby Gibson units are growing twice as fast as year-round units. Presently, short term
Gregg Tivnan residential rentals are not subject to occupancy taxes. According to a rune
Orleans 18,2017 Boston Globe article,Airbnb logged 592,000 guests in .
John Kelly Massachusetts last year and if taxed at 5.7%,the hotel tax occupancy rate,an
Myra Sucheniez estimated$15 million in tax revenue would have been collected. Legislation
Provineetown authorizing cities and towns to apply an occupancy excise on seasonal rental
David Panagore properties will ensure that these new ventures are treated similarly to
David Gardner
Sandwich existing hotels and bed and bzeakfasts that are taxed. Also,it will replace .
George'Bud"Dunham tax revenue lost as bed and breakfasts convert to online platforms. This
Douglas Lapp legislation would provide cities and towns with greatly needed additional
Truro revenue due to rapidly rising housing costs, benefitting'communities
Rae Ann Palmer throughout the state already burdened'by service demands unposed by
Kelly Sullivan-Clark seasonal visitors. Cape Cod communities have historically supported the
Wellfleet imposition of an occupancy excise on seasonal rental properties and by
Dan Hoort home rule petition, have sought authorization to impose the excise. See
Brian Carlson H.2634(Brewster),H2637(Proviucetown),H.2640(Truro),H.2641
Barnstable County (Well feet),H.3792(Falmouth).
Jack Yunits
Steve Tebo Facing novel challenges imposed by these new ventures, explicit
CLC authorization to municipalities to adopt, promulgate and enforce bylaws,
Maggie Downey ordinances, and regulations concerning this type of short term rental is
Yarmouth essential. As with other types of regulated industries, including restaurants
Dan Knapik and bars, hotels, and entertainment facilities, each municipality has an
Chris Dwelley obligation to ensure that a business enterprise operates in such a way as to
President,Robert C.Lawton,Jr. protect the public health and safety. For that reason,we strongly support the
Member—Jim Merriam,Joyce provisions of H.3454 authorizing each municipality to decide whether to
Mason,Charles Sumner,Harry adopt any or all the-local options, and as discussed below, believe that all
Terlkanian,Sheila Vanderhoef cities and towns should have authority to regulate short term rentals to
ensure the public, health and safety, regardless of whether they wish to
