MA 02649 <br /> PUNNING BOARD -MINUTES : 10/1 7/84 cont, Page <br /> Vernon Lope asked how far back From the old ancient way would the <br /> development be and Tarr Lopez asked how far it would be from the bog, <br /> Mr. Marsters said it appeared to be 135' from the closest point of <br /> the ancient way and 165' from the bog, <br /> Hannah Averett commented- on the impact on schools as it 's full right <br /> now and asked what was meant by a special permit , <br /> Atty. Kirrane explained that a special permit provides the town with a <br /> mechanism for reviewing every possible project and review the plans in <br /> detail. <br /> Marilyn Hendricks said she had heard a convenience store would be in <br /> the development, Atty. Kirrane explained that the commercial was - <br /> Separate From this hearing and would come up at a later time . <br /> Ethel and Eric Jensen brought the question up of decreased water <br /> pressure in their area on Asher's Path now due to Augat 's and believe <br /> this development will also have an impact on their water pressure . <br /> Marie Scally wanted to know what guarantee the town has that the <br /> developers won' t rent the units rather than sell them. In such a case <br /> she felt they would only become a glorified housing project . Atty. <br /> irrane said they would be building in 5 phases and if they have <br /> difficulty selling, thea they won't continue with the rest. <br /> Mr. Rowley as-ked ther=e the wells will be located in relation to the <br /> storm drainage . Atty. Kirrane said both in the same area, 2701 radius , <br /> 5401 diameter but it #s not shown on the plan yet . Mr. Rowley said he <br /> would like it shown. Atty. Kirrane felt the-Y could make it a. condition <br /> when they approve the permit but Mr.. Dubin said -a change has been made <br /> and they have to get a revised plan before a decision can be made . <br /> Mrs . Tanneyhill -asked what zoning area is involved as they are planning <br /> to commercial buildings . Atty.. Kirrane explained that under- the by-laws , <br /> if you have a development with at least Zoo units , a commercial building <br /> can be included as part of the overall project. Mrs , Peters asked when <br /> did this by-law go into affect and Mr. Marsters said he would guess <br /> around 1971. <br /> It was the consensus of the audience that no more condominiums be <br /> allowed in town but Mr. Dubin said it was the PlanningBoard 's duty <br /> to uphold the zoning by-laws or it would be illegal .
