The Settlement agreement and superceding order from DEQE on Jaye Boas Trust was reviewed . A letter from BSC re New Sdaury Condo Trust spring fertilization of the coastal bank beach grass per the order of conditions was received * MEADOW HAVEN TRUST : A request for an amended order of conditions was reviewed . VOTE : Motion made and seconded to accept the amendment requested . This amendment does not change the original expiration date of the order , letter to be written to advise if the project is not to be comp- leted by the expiration date of the order an extension must be applied for . The Commission was advised Elliot Rosenberg would be willing to attend the Fee Schedule Meeting at DEQE on June 6 . After dis- cussion , is- cussion , it was agreed attendance by the Commission is unnec- essary . AFTER THE FACT FILING : Mr, Sherman advised Town Counsel stated by a majority vote of the Commission a fee could be created . A statutory penalty was discussed . Mrs . i arsters suggested fines e assessed with enforcement orders . Any provision of the bylaw is punishable by fines . VOTE : Motion rude and seconded to adhere to the existing categories for filing fees but to add a surcharge of 95% for such filings , up to $300 .00 , This administrative fee can be warred at the discretion of the Commission . This is to take effect in 30 days . PORT OY , Sunset Circle , Mr . Sherman advised there is erosion on the back slope to the pond . Mrs . Marsters stated this is an enforcement issue to be fixed prior to a Certificate of Compliance . Letter to be sent .
