Unanimous Vote.
HEARING CONTINUED.
8:35 LANCASTER REALTY TRUST Aunt Jane's Road, continued from
27 April 2000. Michael Grotzke was present with Robert Gray of Sabana, v
Inc. Mr. Rosenberg stepped down for this hearing. Mr. Grot ke presented
the plan that was before the Commission the last hearing. Prior to the last
hearing there was some issue with being able to go out and actually see the
lot, the stakes, and have a site visit. He summarized the things that are
agreed upon and where it stands.
The wetlands delineation was clone by New Seabury in the past; there is no
dispute as far as where the wetlands is located, the limits, flags, buffer zone.
This has been studied very intensely at the Commission's request relative to
the issue of the vernal pooh.. His Tient had been made aware that there was
a significant possibility there would be a vernal pool here. A stdy was done
over many months to research this. As it turns out, at the last hearing, to
their surprise, they were told that was not an issue, it did not need to be
discussed. At the last hearing, it was brought up that......1Ir. Sherman
asked to make a correction, it was not necessary to discuss it because there
has been no indication, to this point, that them is a vernal pool. It docs not
mean, and I think Mr. Gray would agree, that it cannot be a vernal pool, just
that it has not been shown to be at this point.
Mr. gray said, based on the documentation to slate, there is nothing there,
either obligate or facultative that would allow it to be considered as such and
after the last hearing, he did go back 6th and one of the things he wanted to
check is the actual PH level. The PH in that particular dole ranges between
.2 and 5.5. It would be his opinion, based on this gear's readings, that would
be too acidic. Generally,-what he finds in pools with pH in that range is if
eggs are deposited, eggs usually show mortality within two to three weeks
