Board of Health authorization for Title v septic system. <br /> Mr. Hayes made references to the wetland delineation, <br /> vegetation and soils, FEMA flood zone/structure being built to <br /> state building code. The septic system being located fifty-feet <br /> from the wetland area and thirty-five foot setback from BVW. <br /> Diane Boretos took issue with the BVW line, noting this <br /> particular site has more of a fresh water lens than the adjacent <br /> (Smith) site, resulting .n different soil conditions. she <br /> recommenced Mr. Fletcher, a soil specialist, be hired to test the <br /> i <br /> soils at this particular site, all expenses for which are to be <br /> paid by the Applicant as outlined in Chapter 172 . <br /> She volunteered to accompany the person who determined the <br /> wetland line in an attempt to identify/include all of the wetland <br /> plants. <br /> The minimum thirty-five foot setback is being met by one <br /> tenth of an inch, recognizing the size of the lot is small. . <br /> She made reference to benchmark #8 as noted on the plan, <br /> stating the location to be across the river. Mr. Hayes responded <br /> the other FEMA benchmark was damaged, and that he would re- <br /> examine the matter. <br /> With reference to questions raised by Ms. Boretos regarding <br /> the estimated groundwater elevations, Mr. Hays responded that <br /> Board of Health has issued their approval, he could not respond <br /> further on groundwater issues, but that he would be happy to have <br /> his engineer review the matter. <br /> Regarding the preliminary approval of the site/septic <br /> system, Ms. Boretos questioned the figures used in making said <br /> i <br /> determination. water course under 'title v is measured from the <br /> wetlands as defined under the wetlands Protection Act; not being <br /> measured to the salt marsh, which is the figure provided to the <br /> Board of Health. <br /> Mr. Hayes responded this issue should be determined between <br /> the engineers and the Board of Health. <br /> Ms. Boretos read into the record, Title v 15 . 002 : "waters <br /> of the Commonwealth or water Bodies - All waters within the <br /> jurisdiction of the Commonwealth, including without limitation <br /> rivers, streams, lakes, ponds, springs, (inaudible) , wetlands, <br /> estuaries, coastal waters, groundwaters, and vernal pools. <br /> Setback Requirements are fifty 50 ft. ) feet. 'All setbacks <br /> and water bodies should be measured from the bank of the water <br /> body and all setback distances from wetlands shall be measured in <br /> accordance with the criteria of the wetlands Protection Act, if <br /> -5- <br />
