It appears to him <br /> that this was an end around route, <br /> Ills, Grady stated that was their whole point in even corning up with <br /> regulations. <br /> Mr. Ball asked the other board members if they were agreeing that people <br /> can cone in front of the board for a variance or not. <br /> Mr. Harrington replied that they could always come in front of the board <br /> for a variance# <br /> Mr. Ball continued by stating that according to " they couldn't do that. <br /> Mr. Harrington disagreed and stated that they would have to prove to the <br /> board that whatever type of situation that they were going to propose <br /> couldn't be other than the intent of the regulation. They would have to <br /> prove to the board without a doubt that the intent of the regulation is <br /> going to be upheld. That basically means that they will be providing a <br /> smoke free environment, is safety going to be maintained? What is the <br /> exposure? All of these types of things have to been proven to the board's <br /> satisfaction in the intent of this regulation. They have to prove all of these <br /> things in Section i to the board members satisfaction in order for them to <br /> grant a variance. <br /> Mr. Santos stated that he felt that it was life discussing Title V <br /> regulations. They could obtain a variance but they would have to prove <br /> the necessity for doing so. correct? <br /> Mr. Ball suggested that they use the town hall for an example. if they were <br /> to come in front of the board members to state that they want a variance. <br /> for a designated area outside for smoking. They already have in their <br /> regulation that they cannot smoke on toren property. They could grant <br /> that variance? Then they could go and smoke. <br /> Mr. Santos replied that in a situation like that he would say yes. <br /> Ms. Grady stated that if they looped at it as a board and determine that it <br />
