Stevenson and Doc.: #1121836
Farhana R. Stevenson, Trustees Ctf.: #189321
431 Monomoscoy Road
(Map 124 Parcel 53)
Mashpee, MA 02649
A Petition was filed on October 31, 2017 by Owners, Jeremy N. and Farhana R.
Stevenson, Trustees requesting a Written Finding under §174-17 of the Zoning Bylaws to
allow for construction of a lap pool on property located in an R-3 Zoning District, (Map
124 Parcel 53), Mashpee, MA.
Notice was duly given to abutters in accordance with Massachusetts General Laws
Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of
general circulation in the Town of Mashpee, on November 10, 2017 and November 17,
2017 a copy of which is attached hereto and made a part hereof.
Public Hearings were held on the Petition at the Mashpee Town. Hall on
Wednesday, December 13, 2017 at which time the following members of the Board of
Appeals were present and acting throughout; Acting Chairman, William Blaisdell, Board
Members, Dom DeBarros, Scott Goldstein, and Associate Members, Brad Pittsley and
Sharon Sangeleer. Also present was Building Commissioner, Michael Mendoza.
Attorney Kevin Kirrane represented the applicants for the request of a lap pool.
Also present was Tom O'Neil, who designed the building. He provided a narrative and
photographs of the area. There is a substantial raised patio structure on the rear of this
property and the project consists of taking a portion of that structure out and replacing it
with a lap pool, and adding only about 195 sq. ft. of area, which is in dimension of 10' x
57'.
The reason for the application is because the 195 sq. ft. right hand corner of the
pool that's adjacent to the Great River side of the property is getting closer to the wetland
resource area than what currently exists. The lot coverage is increasing slightly from 18.8%
to 19.5% and the setback to the wetland resource area of the saltmarsh is going from at 36
ft. down to 30 ft.
1
