Brady for a Special Permit SP-92-83
A Petition was filed by Richard P. and Julia A. Brady of
Palos Verdes Peninsula, California for a Special Permit under
Section 174-25.I.9 of the Zoning By-laws for an existing platform,
ramp and floats in an R-3 zoning district on property located at
256 Monomoscoy Road (Map 120,. Block 56) Mashpee, Massachusetts.
Notice was duly given to abutters in accordance with Massachusetts
General Laws Chapter 40A. Notice was given by publication in The
Enterprise, a newspaper of general circulation in the Town of Mashpee
on November 20 and November 27, 1992, a copy of which is attached
hereto and made a part hereof.
A public hearing was held on the Petition at the Mashpee Town
Hall on Wednesday, December 9, 1992 at 7:30 P.M. at which time the
following members of the Board of Appeals were present and acting
throughout: John J. Friel, Michael A. Makunas and Cheryl A. Hawver.
Engineer John Slavinsky represented the applicants and explained
that the existing structures were built in 1980 and the owners were
in the process to obtaining all licenses. He reported that Conservation
had approved the application and that no changes or improvements were
planned.
The Board found that the use was in harmony with the general
purpose and intent of the by-laws and complied with the provisions
therein. The Board determined that the structure would not interfere
with free passage of travel by water or land or cause disruption to
the marine or coastal environment.
