Knudson for a Variance V-92-85 <br /> A Petition was filed by Jon and Nancy A. Knudson of <br /> Mashpee, Massachuseets for a Variance from Section 174-31 of <br /> the Zoning By-laws for permission to vary the setback <br /> requirements in an R-3 zoning district on property located at <br /> 11 Asg St . (Map 77 , Block 33 ) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with <br /> Massachusetts General Laws Chapter 40A. Notice was given by <br /> publication in The Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee, on November 20 and <br /> November 27 , 1992 , a copy of which is attached hereto and <br /> made a part hereof . <br /> A Public Hearing was held on the Petition at the Mashpee <br /> Town Hall at 7 : 30 P .M. on Wednesday, December 9, 1992 at <br /> which time the following members of the Board of Appeals were <br /> present and acting throughout : John J. Friel , Michael A. <br /> Makunas and Cheryl A. Hawver . <br /> Jon Knudson and William Wool, builder, represented the <br /> Petition. Mr . Knudson explained that he had an existing <br /> house and deck located 28 ' from a paper road which is not <br /> passable. He plans to enclose a deck as a house addition with <br /> a setback of 28 . 2 ' from Falmouth Road. <br /> The Board found that the topography of the lot created a <br /> hardship affecting the land in question but not the zoning <br /> district in which it is located and that relief could be <br /> granted without derogating from the intent or purpose of the <br /> by-law or without detriment to the neighborhood. <br />
