ToWn of Oa obpee <br /> : a <br /> 16 GREAT NECK ROAD NORTH <br /> MASHPEE, MA 02649 <br /> ABLE ro` <br /> BOARD OF APPEALS <br /> Decision <br /> for a Special Permit <br /> Re : Nikolaos Hatzidis for a Special Permit SP-92-90 <br /> A Petition was filed by Nikolaos Hatzidis of <br /> Shrewsbury, Massachusetts for a Special Permit under <br /> Section 174-17 of the Zoning By-laws for permission to <br /> build on a non-conforming lot in an R-5 zoning district <br /> on property located at 309 Hooppole Road (Map 41 , Block <br /> 61 ) Mashpee, MA. <br /> Notice was duly given to abutters in accordance <br /> with Massachusetts General Laws Chapter 40A. Notice was <br /> given by publication in .The Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee , on November <br /> 20 and November 27 , 1992 , a copy of which is attached <br /> and made a part hereof . <br /> A Public Hearing was held on the Petition at the <br /> Mashpee Town Hall at 7 : 30 P .M. on Wednesday, December 9 , <br /> 1992 at which time the following members of the Board of <br /> Appeals were present and acting throughout : John J. <br /> Friel , Michael A. Makunas and Cheryl A. Hawver. <br /> Harry Hatzidis represented the applicant and <br /> explained that he and his father held adjoining lots in <br /> separate ownership since 1987 . The lots are part of an <br /> early subdivision plan and are -similar in size to the <br /> adjoining lots . <br /> The Board found that the use is in general harmony <br /> with other permitted uses in this zoning district, the <br /> change or extension is not substantially more <br /> detrimental than the existing condition and that relief <br /> can be granted without derogating from the intent of the <br /> by-law or without detriment to the neighborhood. <br />
