TOWN <br /> Town of Aaobpee <br /> 16 GREAT NECK ROAD NORTH <br /> r4� ,j�Yy MASHPEE, MA 02649 <br /> S ULF F <br /> BOARD OF APPEALS <br /> Decision for a Variance <br /> RE: Nikolaos Hatzidis for a Variance V-92-91 <br /> A Petition was filed by Nikolaos Hatzidis of Shrewsbury, <br /> Massachuseets for a Variance from Section 174-31 of the <br /> Zoning By-laws for permission to vary the lot size, frontage <br /> and setback requirements in an R-5 zoning district on <br /> property located at 309 Hooppole Road (Map 41 , Block 61 ) <br /> Mashpee, MA. <br /> Notice was duly given to abutters in accordance with <br /> Massachusetts General Laws Chapter 40A. Notice was given by <br /> publication in The Enterprise, a newspaper of general <br /> circulation in the Town .of Mashpee—on-November 2.0 and <br /> November 27 , 1992 , a copy of which is attached hereto and <br /> made a part hereof . <br /> A Public Hearing was held on the Petition at the Mashpee <br /> Town Hall at 7 : 30 P .M. on Wednesday, December 9 , 1992 at <br /> which time the following members of the Board of Appeals were <br /> present and acting throughout : John J. Friel , Michael A. <br /> Makunas and Cheryl A. Hawver. <br /> Harry Natzidis represented the applicant and explained <br /> that a potential buyer for his land wished to have a house <br /> built and that zoning in the area had changed since the <br /> original subdivision and it would be impossible to meet the <br /> new sideline setback requirements. <br /> The Board found that the topography of the lot created a <br /> hardship affecting the land in question but not the zoning <br /> district in which it is located and that relief could be <br /> granted without derogating from the intent or purpose of the <br /> by-law or without detriment to the neighborhood . <br />
