town of Aaobpee
11 16 GREAT NECK ROAD NORTH
vylMASHPEE, MA 02649
s csr
BOARD OF APPEALS
Decision for a Variance
RE: Haralombos Hatzidis for a Variance V-92-93
A Petition was filed by Haralombos Hatzidis of
Shrewsbury, Massachuseets for a Variance from Section 174-31
of the zoning By-laws for permission to vary the lot size,
frontage and setback requirements in an R-5 zoning district
on property located at 311 Hooppole Road (Map 41 , Block 60 )
Mashpee, MA.
Notice was duly given to abutters in accordance with
Massachusetts General Laws Chapter 40A. Notice was given by
publication in' The Enterprise, a newspaper of general
circulation in the Town of Mashpee, on November 20 and
November 27 , 1992 , a copy of which is attached hereto and
made a part hereof .
A Public Hearing was held on the Petition at the Mashpee
Town Hall at 7 : 30 P .M. on Wednesday, December 9 , 1992 at
which time the following members of the Board of Appeals were
present and acting throughout : John J. Friel, Michael A.
Makunas and Cheryl A. Hawver.
Harry Hatzidis represented the applicant and explained
that a potential buyer for his land wished to have a house
built and that zoning in the area had changed since the
original subdivision and it would be impossible to meet the
new sideline setback requirements.
The Board found that the topography of the lot created a
hardship affecting the land in question but not the zoning
district in which it is located and that relief could be
granted without derogating from the intent or purpose of the
by-law or without detriment to the neighborhood.
