MA 02649 <br /> LE�°� BOARD OF APPEALS <br /> DECISION <br /> FOR A SPECIAL PERMIT <br /> RE: Baybury Village Association for a Special Permit SP-92-89 <br /> A Petition was filed by the Baybury Village Association of Mashpee, <br /> Massachusetts for a Special Permit under Section 174-25.I.9 of the <br /> Zoning By-laws for permission to construct a stairway, pier, gangway <br /> and float in an R-3 zoning district on property located on Godfrey <br /> Road (Map 96, Block 104I) Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on November 20 and November 27, 1992, a copy of which is attached hereto <br /> and made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, December 9, 1992 at 7:30 P.M. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: John J. Friel, Michael A. Makunas and Cheryl A. Hawver. <br /> Engineer Douglas Cameron represented the applicants and presented <br /> plans for a stairway, pier, gangway and float to be used by residents <br /> of Baybury Village. The Board was informed that Association members <br /> who want to use the dock can participate in the construction costs. <br /> The Board found that the use was in harmony with the general <br /> purpose and intent of the by-laws and complied with the provisions <br /> therein. The Board determined that the structure would not interfere <br /> with free passage of travel by water or land or cause disruption <br /> to the marine or coastal environment. <br /> I <br /> ,a. <br />
