r <br /> Mr. Baker expressed concern about the phosphorus issue and not knowing how sewering plans will <br /> impact the issue. Mr. Theis questioned the impact of the Conservation Law Foundation lawsuit. <br /> OLD BUSINESS <br /> Action Items <br /> Zero Phosphorus Lawn Fertilizer Bylaw Update <br /> Mr. Baker expressed his support of Town Counsel's review and work on the Zero Phosphorus Bylaw <br /> and recommended that the document be forwarded to other committees. Chairman Cahalane added <br /> that he is concerned about forcing store owners to remove the product. Committee members decided to <br /> delete section 6E but maintain section 6F and forward the revised document to the Board of Health and <br /> the Conservation Commission for comments. <br /> Mr. Theis made a motion that the Environmental Oversight Committee recommend the bylaw as <br /> drafted by Town Counsel for the sale and application of lawn fertilizer and that it be submitted <br /> for the spring Town Warrant as modified, deleting section 6E. Mr.Baker seconded the motion. <br /> Roll call vote: Mr. Theis-yes; Mr. York-yes; Chairman Cahalane-yes; Mr. Baker-yes <br /> Committee members discussed the hope that other towns will follow Mashpee's lead as a best <br /> management practice. Chairman Cahalane noted that approximately 80% of respondents to the town <br /> survey voiced their support of a fertilizer bylaw. Mr. Baker suggested a future possibility of <br /> addressing the nitrogen content of fertilizer and W. York suggested the recycling of seaweed as <br /> fertilizer. <br /> Mashpee River Restoration <br /> Mr. Baker recommended that the BOS be encouraged to address the Mashpee River and questioned <br /> inviting experts such as Brian Howes to consider ways to improve the river. Mr. Baker discussed the <br /> results of the report and regeneration of the sediments. Mr. Baker questioned evaluating the benefits of <br /> marsh reconstruction to improve the river and suggested finding out the costs associated with the <br /> project. Mr. York reported that the oysters favor denitrifying bacteria and that large amounts of <br /> nitrogen is being removed by the bacteria, possibly more than the oysters. Mr. Howes has been <br /> conducting testing, the results of which are not yet known. <br /> Chairman Cahalane stated that the EOC serves as an advisory committee to the BOS and can advise <br /> the BOS that the EOC believes an expert should be consulted. Mr. Baker will provide members of the <br /> Committee with his proposal that he presented to the Waterways Commission, Mr. Theis questioned <br /> use of blended spoils and harvested seaweed to develop an end product that could be used for <br /> commercial purposes and create income. Mr. York responded that it could be possible and Mr. Theis <br /> indicated that he will research the possibility. <br /> Grant Applications <br /> Mr. Baker suggested eliminating grants as a separate action item and include them with the specific <br /> action items to which they are related. The Chair noted the importance of having someone actively <br /> pursue grants. <br /> Town-Wide Stormwater Management Plan <br /> Mr. Baker reiterated concerns about the disconnect between the Planning Board requirements and <br /> DPW requirements for road specifications and recommended that the BOS be advised to adopt the <br /> 3 <br />
