Thompson, Zoning Consultant <br /> Issues were raised at the Plan Review meeting held on August 14, 2008, and at an earlier Plan <br /> Review meeting, regarding the proposed change of use in Emit#5, 129 Independence Drive, <br /> leased by Gary Beaulieu, Foley Auto Repair. The building 1s owned by Frank Silva and Mr. <br /> Silva obtained a special permit in 2004 that allowed for a contractor's yard for landscaping, <br /> wholesale and indoor and outdoor storage. Six unfits and an office were approved by the Board <br /> of Appeals, in accordance with the submitted plans, a copy of which was attached to my <br /> memorandum dated August 14, 2008. <br /> Gary Beaulieu has been operating in'knit#5 since June and immediately upon learn ng that this <br /> use requires a special permit, Mr. Beaulieu submitted an application to the Zoning Board of <br /> Appeals. <br /> Septic Issues <br /> The issue of whether or not the septic system that was installed is adequate for the proposed and <br /> existing uses was raised. After consultation with Glen Harrington, Jack Lander -Cauley, PE, <br /> submitted a letter and met with the Board of Health on September 1 oth. Mr. Silva has agreed to <br /> increase the size of the soil absorption system from 444 gpd to 599 gpd; 150 gpd would be <br /> designated for Unit#5. The remaining 449 gallons would be divided between the remaining <br /> units on a pro-rated basis because each unit varies in size. <br /> According to Jack Danders-Cawley,this arrangement with the Board of Health was determined to <br /> be acceptable. <br /> Parkin <br /> At the Plan Review meeting on August 14th it was determined that there was adequate arkin <br /> g <br /> on the property for the existing and proposed uses. It was asked if the existing parking met the <br /> requirements of the Americans with Disabilities Act(ADA). The Act states that when the <br /> required parking ranges between 26 to 50 spaces 2 handicapped accessible parking spaces must <br /> be provided. A copy of Section 4 of the ADA is attached to this memorandum. <br /> Twenty-six parking spaces are shown on the approved plan and two spaces were designated as <br /> handicapped accessible spaces.
