1. Psychoilggical <br /> All candidates who have satisfactorily completed the aforementioned testing system and have <br /> been medically qualified will be required to undergo a psychological examination. <br /> A candidatc(s)who is found to have a potentially disqualifying condition or impairment will have <br /> his/their case(s) automatically reviewed in accordance with the procedures/provisions of Article <br /> IIIA, Section 2, 3, and 4 of the current contract agreement between the Town of Mashpee and <br /> Local 389 IBPO. Said procedure will determine the final psychological qualification. A <br /> candidata who has been found to have a potentially disqualifying condition shall not be eligible <br /> for appointment/promotion. Notwithstanding any provision of the most current agreement <br /> between the Town of Mashpee and Local 3811 1BPO, said final determinadon/Appeal Decision <br /> 'Re: Final psychological examinations qualification status shall he non-grievable and non- <br /> arbitrable. <br /> m. The final list of fully qualified candidates along with pertinent data will be submitted by the <br /> Personnel Board to the Board of Selectmen with or without the reconunendation(s), if any, of the <br /> Chief. Upon his/her written request, an employee will be provided all the written material <br /> provided to the Selectmen, except the recommendation of the Chief. The Selectmen have the sole <br /> discretion to decide whether and when to till a vacancy and to choose which applicant will be <br /> selected. If the appointment/promotion is made from one of the top six (6) full qualified <br /> candidates on a duly-constituted list(i.e., as prescribed above, the Board's decision shall be non- <br /> grievable and non-arbitrable. <br /> n. All examination scores will be kept in a file by the personnel Board, and each candidate will be <br /> allowed to view his/her own score, if requested: All examination scores will be available to the <br /> President of Local 389. <br /> 5) In the event of an overall failure to qualify, after a minimum of six months from the last written exam <br /> date, the entire promotion process will be reaccomplished as aforesaid. <br /> 6) Officers have the right to refuse any promotion without prejudice of any kind. <br /> 7) If all candidates on a duly-constituted list are by-passcd for promotion, the entire promotion process <br /> to establish a new list will be reinitiated within six (6) months, commencing with the date the duly <br /> constituted list was officially by-passed. <br /> 8) No employee will be excluded from the promotion process based solely on race, sex, religion or <br /> ethnic origin. <br /> 9) This rule is to be used in conjunction with all relevant existing Department Orders, Rules and <br /> Regulations, Policies, Procedures, Memoranda, and Directives. <br />
