APPROVAL OF MINUTES—June 6,2018 <br /> The Chair inquired whether the minutes included Mr. Almeida's comments that, as part of <br /> developing a form-based code, there should be a master plan. The Chair asked that it be added to <br /> the minutes. Following the meeting, the Board Secretary found the content located at the bottom <br /> of page 6, reading"Four components of form based code was described as, vision centered, <br /> written as part of a master plan, binding public and private interests; purposeful, and priority <br /> driven, concentrating on regulating with emphasis on those areas that were prone to change; <br /> place based, code prescriptions carefully calibrated specific to the setting to which they are <br /> applied; and consequential urbanism, not an exercise in beautification." <br /> MOTION: Mr. Balzarini made a motion to approve the minutes as amended. Mr. <br /> Kooharian seconded the motion. All voted unanimously. <br /> PUBLIC HEARINGS <br /> 7:10 p.m. Applicant: William Lovely,Property Owner <br /> Property: 2 Center St, (Assessor's Map 36,Lot 47) <br /> Request: Special Permit Modification to list 174-25(B10), "Day nursery, <br /> nursery school, kindergarten or other agency giving day care to children, <br /> provided that any outdoor play area is screened by fence,wall or planting <br /> line from any neighboring residential structure and is not detrimental to the <br /> neighborhood by reasons of noise," of the Mashpee Zoning Bylaw. <br /> The appointed time having arrived, Chairman Waygan read for the record the public hearing <br /> notice and opened up the continued public hearing. Owner of 2 Center Street,Bill Lovely, stated <br /> that he had followed up with Robert Our, and provided documentation to Mr. Rowley regarding <br /> the access hatch installed on the property. <br /> Mr. Rowley confirmed that he was in receipt of the specifications for the cover but stated that he <br /> saw no indication of the type of cover described. One specification noted it was steel, a second <br /> specification indicated that it was aluminum. The aluminum cover could be used in limited areas <br /> but for parking, the bottom of the specification referenced use of a steel cover. Mr. Rowley <br /> expressed concern regarding the location of the aluminum cover in the driving area. Within the <br /> drafted Special Permit Modification No. 2, an allowance was made to allow Mr. Lovely four <br /> months to make the cover appropriate. Mr. Rowley inspected the site, providing photographs of <br /> the location and parking scheme. Mr. Rowley was not prepared to state that it was an appropriate <br /> cover for the location. <br /> Mr. Lovely stated that the loading of the cover was good for trucks, but was in agreement with <br /> Mr. Rowley that the steel cover was more appropriate. Mr. Lovely stated that the condo <br /> association owned the parking lot and it was his opinion that he should not have to do something. <br /> Mr. Lovely stated that the condo association had a $100,000 bond with the Board of Health for <br /> the septic system, for which the cover was the access, and they agreed to address the issue based <br /> on Mr. Rowley's comments. Mr. Lovely stated that the condo association would work with <br /> Robert Our to fix the hatch, but Mr. Lovely felt that it should not be tied to his Modification. <br /> 6 <br />
