Draft I - March 16, 1995
Commission may impose such conditions as it deems necessary so as to ensure that
the standards of no. 2 (directly above) are met.
All maintenance and improvement activities shall be undertaken in such a
manner as to prevent erosion and siltation of adjacent water bodies and wetlands, as
specified by the U.S.D.A. Soil Conservation Service ''Guidelines for Soil and Water
Conservation."
or take any other action relating thereto.
Submitted by the Conservation Commission
Explanation: Since the original version of the "agricultural exemption" was
written into Mashpee's Bylaw, State wetland regulations have been weakened to
allow activities damaging to wetlands interests, with actual damage being done to the
Santuit River in terms of trout habitat. This measurer, along with another article, are
designed to bring alterations to waterways, ponds, streams, rivers, and wetlands
back under the review of the Conservation Commission.
Article 45. I IV N
To see if the Town will v to to amend Section 7 f Chapter 172 of the Mashpee
Nr-14
Code by adding the follow*n to 7.A:
(1) Lands within 100 feet o ecific resourc areas are presumed important to the
protection of these resour" 14 because a tivities undertaken in close proximity
to wetlands and other resource areas ve a high likelihood of adverse impact
upon the wetland or other res rce ea, either immediately, as a consequence
of construction, or over time, a a nsequence of daily operation or existence
of activities. These adverse imp cts from construction and use can include,
without limitation, erosion, si at'on, loss of groundwater recharge, poor
water quality, and loss of wil 'fe itat. The Commission therefore may
require that the applicant ma' in a co tinuous naturally vegetated buffer strip
(NUBS) within the 1 00-foo area from y resource area. (This requirement
will not preclude access athways thro h said NUBS, as determined by
regulations for this Chapt r.) Said NUBS uld have to be a minimum of 50
feet in width unless th applicant convinc the Commission (as per the
provisions of Section 2 of this Chapter) that. (a) the NUBS (or part of it)
may be disturbed and or diminished without ha to the values protected by
this Chapter, and that reducing the scope work/alteration is not
possible.
Page 21
