The Chair inquired whether the information had been provided in the <br /> packets and Mr. Lehrer confirmed that it had not, but that he would forward the information to the <br /> Board. The Chair recommended that the project proponent point out to Mr. Weeden the delineation of <br /> the protected area in relation to the project area. <br /> Chairman Waygan inquired about changes to the retaining wall and whether there was a need to <br /> include it as a condition. Mr. Rowley responded that he had been in contact with Mr. Eddy regarding <br /> the retaining wall, who indicated that, as a structure, it would fall under the jurisdiction of the building <br /> inspector. However,Mr. Rowley pointed out that any significant changes to the location of the wall, <br /> may require a modification to the Special Permit. Mr. Rowley noted that a similar situation had <br /> previously occurred at Southport. Mr. Rowley suggested that a condition be written into the Special <br /> Permit, noting that once the information was submitted to the Building Inspector, details would also be <br /> submitted to the Planning Board. Mr. McElhinney agreed to the suggestion. Regarding drainage, Mr. <br /> Rowley confirmed that drainage was relocated in two places to provide better access and modifications <br /> were made to the plans. <br /> The Chair inquired whether it was expected that the request would extend to a third meeting, noting <br /> that Mr. Weeden was not currently present, who had previously expressed some concerns. The Chair stated that there <br /> were 4 members seated for the request, for a vote and Mr. McElhinney expressed his preference for the <br /> matter to move forward. It was confirmed that Mr. Hansen was present to vote, as an alternate. <br /> Mr. Hansen supported the project, provided the drainage fulfilled Mr. Rowley's requirements. Mr, <br /> Balzarini indicated that he was fine with the request. Mr. Cummings inquired whether the project <br /> proponent was in agreement with Mr. Rowley's letter and Mr. McElhinney agreed, indicating that he <br /> had been in touch with Mr. Eddy. Mr. Cummings inquired about emergency power for the grinder <br /> pump and Mr. Eddy confirmed that the grinder pump for the single building provided for 24 hours of <br /> emergency storage in the well. <br /> Mr. Lehrer reported that DPW Director Catherine Laurent forwarded an email regarding a culvert and <br /> road improvements being developed in conjunction with Barnstable and communicated to Mr. Eddy. <br /> Mr. Rowley discussed the contents of his September 4 letter, including the retaining wall, stating that <br /> any adjustments to the wall should again be reviewed by the Planning Board. The Chair agreed that it <br /> should be made a condition, which Mr. Lehrer would add to the Special Permit Modification. Mr. <br /> Rowley stated that stormwater system S, with a grass Swale along Sampsons Mill Road, would sit on a <br /> 15% slope, and would require stabilization during construction to prevent erosion, with grass installed. <br /> Mr. Eddy agreed that the area would need stabilization, along with other areas at the site, and did not <br /> feel that additional notation was necessary. Mr. Rowley suggested including notes on one copy of the <br /> plan and documented in the Special Permit Modification since it would be subject to inspection. Mr. <br /> Rowley confirmed that there had been discussion with the Deputy Fire Chief consenting to the project <br /> and Mr. Eddy confirmed that he forwarded correspondence to Mr. Lehrer and Mr. Rowley.
