Dianne Scannel, 108 DeGrasse Road, stated that, sitting on her back deck, she would be looking <br /> directly at the tower and expressed her opposition. Ms. Scannel also stated that it made no sense to re- <br /> zone an area that was already zoned. <br /> Deirdre Greelish, Pond Circle, stated her opinion that it was premature to consider the Article without <br /> a ruling from the Cape Cod Commission, and recommended that the Article be tabled. <br /> Dean Berrin, 6 Overlook Drive, has installed towers, indicating that there had been no mention of a <br /> "fall zone," in case a tower crashed. Mr, Berrin provided the example of a recent fire and crash that <br /> occurred in Wellesley during regular maintenance activities. Mr. Berrin inquired whether a fall zone <br /> had been considered and the Chair responded that the project was before the Cape Cod Commission, <br /> but that it would be considered when it was before the Planning Board. Mr. Lehrer confirmed that the <br /> Zoning Bylaw contained fall zones. Mr. Berrin inquired whether there were homes located within the <br /> fall zone and Mr. Cummings responded that there was nothing within 150 feet. The Chair stated that <br /> the question was currently out of the purview of the Planning Board until it returned from the Cape <br /> Cod Commission. Mr. Berrin suggested that elevation would be far superior on the golf course at New <br /> Seabury, which could also be a safer location. <br /> Brian Baumgaertel, DeGrasse Road and Chair of the Board of Health, referenced a draft decision from <br /> the Cape Cod Commission, made publicly available on line this afternoon, noting that one of the <br /> recommendations was to propose an amendment to the Overlay District. <br /> Mr. Cummings stated that there were no buildings within the 300 feet of the proposed tower and Mr. <br /> Lehrer again stated that there should be no comment on the proposed project. <br /> Peter Michaelson, 120 DeGrasse Road, stated that he was against the proposal, referencing a prior <br /> proposal to build a cell tower in New Seabury, which was voted down by residents. Mr. Michaelson <br /> also stated that a property line did not exist in the Land Court Recorded Plan. It was noted that their <br /> properties could be developed, placing structures within.300 feet of the cell tower. <br /> The Chair asked to close the Public Hearing and inquired whether there was additional brief public <br /> comment, <br /> MOTION: Mr. Balzarini made a motion to close the Public Hearing for the Wireless Overlay <br /> District. Mr. Kooharian seconded the motion. All voted unanimously. <br /> There was discussion regarding the motion to be made due to the lack of information. <br /> MOTION: Mr. Balzarini made a motion to make a recommendation to Torun Meeting to not <br /> approve this proposed Bylaw. Mr. Kooharian seconded the motion. All voted unanimously. <br /> Mr. Balzarini stated that he had cell service, but his wife and son did not. Mr. Balzarini suggested that <br /> perhaps using a site on the golf course at New Seabury would provide all with better service. <br /> 6 <br />
