Mr. Talbot reported that he had been invited to present the nitrogen fertilizer regulations, distributed <br /> by the Cape Cod Commission, to Mashpee's Board of Health. Mr. Talbot_indicated that the Board <br /> of Health expressed reluctance in adopting the regulation due primarily to enforcement issues. It <br /> was announced at the meeting that the State passed a law that would extend ihe period to one year, <br /> in order to allow towns to enact the legislation. Mr. Talbot followed up with the Cape Cod <br /> Commission, who was clarifying the details about the law- <br /> Mr.ir. Talbot recommended reviewing the proposed regulations more closely, should the time be <br /> extended. Selectman Cahalane recommended adopting regulations similar to Falmouth's bylaw as <br /> it would better reflect a regional approach to the issue. Mr. Talbot pointed out that their bylaw <br /> addressed the same items as the Cape Cod Commission, but that it was stricter regarding the total <br /> amount of nitrogen. Mr. Talbot pointed out that both the Orleans and the Falmouth regulations <br /> passed overwhelmingly at Town Meeting. Falmouth will enforce the regulation through the Natural <br /> Resource Department. Selectman Cahalane suggested the possibility, with the extension, of passing <br /> regulations through Town fleeting. The Chair thought the Board of Health was the more likely <br /> option. <br /> Chairman Petersen expressed many concerns regarding he Cape Cod Commission's regulations and <br /> the lack of factual detail and documented references. The Chair felt that the document was unclear <br /> about the problem and went beyond the case for fertilizer control. The Chair expressed concern that <br /> the regulations could be picked apart and nitrogen management would fail at Town Meeting. fir. <br /> Talbot stated that fertilizer management controls, reducing nitrogen by 00, would reduce <br /> Mashpee's nitrogen load by 9,700 pounds, resulting in 1,000 homes not requiring sewering and a <br /> savings of$40 million. <br /> Selectman Cahalane recommended reviewing Falmouth,'s bylaw and Mr, shite agreed. Selectman <br /> Cahalane suggested that it may make more sense to promote a regulation similar to a neighboring <br /> town., should Falmouth"s bylaw be determined that it also meets the needs of Mashpee. Selectman <br /> Cahalane pointed out that Falmouth and Mashpee shared a common estuary and that it would be <br /> difficult to promote-a different set of nitrogen regulations and the Chair agreed about the value o <br /> uniformi <br />
