MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A WRITTEN FINDING <br /> Robert J. V. Roche and Donna M. Roche, Trustees <br /> 401 Monomoscoy Road (Map 124 Parcel 64) <br /> Mashpee, MA 02649 <br /> FINDING-2018-41 <br /> 3. The proposed addition, based upon the plans submitted to the Board, will be <br /> consistent with applicable State and Town statues, regulations, bylaws and plans, <br /> complies with the dimensional requirements applicable to the lot under current <br /> provisions of §174-31 (Land Space Requirements Table Footnotes) #18 of the <br /> Popponesset Overly District, or for lots which have been developed pursuant to <br /> §174-2 1,complies with such requirements as were applicable to initial construction <br /> of the dwelling under provisions of§174-21 Nonconforming lots. <br /> 4. Construction of the lavatory in the garage is contingent upon Board of Health final <br /> approval. <br /> 5. Construction of the lavatory will conform to current building code requirements. <br /> 6. There is adequate land area to provide sufficient parking and setbacks as may be <br /> required. <br /> In view of the foregoing, the Board determined the Petitioners met the criteria for <br /> a Written Finding. Upon motion duly made and seconded at the Public Hearings on <br /> Wednesday,July 25,2018,the Zoning Board of Appeals voted 4 to 1 in favor of the Written <br /> Finding to allow for construction of a lavatory in the detached garage. under §174-24 (K) <br /> on property located in an R-3 Zoning District, Map 124 Parcel 64, Mashpee, MA, with the <br /> following specific conditions; <br /> 1. Conditioned upon all Town Department comments read into the record. <br /> 2. Conditioned that the garage cannot be finished with a bedroom or any type of living <br /> space. <br /> 3. Conditioned that the proposed bathroom be approved as a half-bath consisting of a <br /> lavatory and a toilet, no shower can be allowed. <br /> 4. Conditioned upon no kitchen facilities. <br /> 5. Conditioned that the heating system be a Modine type heating system or similar. <br /> 4 <br />
