board mixed use does. Right now, Mashpee Commons could do this with a <br /> Chapter 40B or could do it with our open space bylaw and that has an open <br /> space requirement. She asked that the members think about what is a <br /> reasonable amount of open space to require. Is it too much or too little? She <br /> noted it is in our comprehensive plan to set aside 50% of the developable land <br /> and open space and the rural of the character of the town has been cited as a <br /> high priority of the residents of the town. This covered Section C in the proposed <br /> bylaw. She asked if the committee could give her some ideas on the value of the <br /> open space. <br /> Mary Waygan then referred to Section H which talked about water quality <br /> requirements so their development would have to be connected to a municipal <br /> sewer system or a private wastewater treatment facility designed to reduce the <br /> total nitrogen in its effluent to less than 3 mg per liter. If you have that for 1500 <br /> new dwellings that could have a serious impact. It was noted the town is facing a <br /> huge sewering cost and are we going have to subsidize a huge mixed-use <br /> development at Mashpee Commons. She noted the Planning Board doesn't <br /> have a master plan from Mashpee Commons and doesn't know where these <br /> units are going to go and how many units are going to go where. There was a <br /> discussion on the Comprehensive Watershed Nitrogen Management Plan which <br /> includes Comprehensive Wastewater Management Plan which is designed to <br /> restore water quality and build out at current conditions. The Chair commented <br /> on stormwater runoff and the permit should include all stormwater has to be <br /> contained on-site and managed through "green infrastructure". Mary Waygan <br /> noted Mashpee Commons' form base code would erase all the zoning on their <br /> land and replace it with their new form base code. She said we have our own <br /> rules and regulations and design standards for things like drainage. She said <br /> she will send them to the Chair so the members can review. The Chair noted <br /> restrictions on turf area, fertilizer should also be included. The nitrogen load is <br /> the number one issue by far. <br /> Mary noted Mashpee Commons has scanned all their maps and all their <br /> information can be found on Mashpee Commons By Design. She said the <br /> planning board will be thinking about this for the next couple of weeks and she <br /> will be recommending to the planning board to write another letter to the Chair of <br /> the Board of Selectmen saying we don't want to go forward at this time but still <br /> think this is the better road to follow. She said the Form Base Code is 250 pages <br /> and anytime they want to make changes Mashpee Commons has to go back to <br /> town meeting but if they use the mixed use by law, they will have to come back to <br /> the Planning Board. She said the residents will have to trust the Planning Board <br /> to approve a master plan that takes all of these comments into consideration. <br /> 2 <br />
