Chairman Ferragamc, said the <br /> Board Would do what ' s legal and they will send the information to <br /> Town Counsel received from the applicant and receive her comments <br /> and consider them when they deliberate. Chairman Ferragamc, said <br /> the 90 days run tut October 2 and there' s a meeting scheduled for <br /> September 20 and it will be brought to a conclusion as the Board <br /> is not prepared to render a decision tonight as there' s still <br /> some research to be done. Chairman Ferragamo said the issue may <br /> be who' s expected to }:now what before they buy land. He said the <br /> Board issued a decision in accordance with its regulations and <br /> deemed the property open spare and by statute you can' t divide <br /> open space. Chairman Ferragamo said Town Counsel will have to <br /> give her opinion and maybe it ' s the Court ' s place to settle that <br /> issue. <br /> MOTION made by Mr . Coffey and SECONDED by Mr . Balzarini <br /> and unanimously VOTED to continue the public hearing tc, <br /> September 20, 1995, 7: 00 p. m. at Town Hall . <br /> Chairman Ferragam- asked Mr . Smith to go to Mr . Writenhour and <br /> stress the importance of faxing Mr. Sullivan' s response to Town <br /> Counsel and how important it is to get an answer back: from Town <br /> Counsel immediately, and definitely before the September 20 <br /> meeting. He also said she should be asked for any additional <br /> advice on wording for a motion on the decision. <br /> Mr . Coffey said at some point in time the Board needs to get <br /> clarification on who caan file a plan and does the Board have <br /> jurisdiction in questioning that . <br /> The Beard agreed to inform Town Counsel of the possible taking by <br /> the Water District for her own information. <br /> OTHER ITEMS <br /> Mr . r-:--,wley asked if he could get a ropy of the Zoning Sylr-iws. <br /> Chairman Ferragamo said he would check with Mr . Fudala to see if <br /> he could get them through his department. <br /> MOTION made by Mr .
